Chouhan urges PM to convene meeting of CMs on Food Safety Act
Madhya Pradesh Chief Minister Shivraj Singh Chouhan has written to Prime Minister Manmohan Singh
demanding that implementation of the Food Safety and Standards Act 2006
be kept in abeyance until issues concerning its provisions are resolved
and also urged him to convene a meeting of all chief ministers at the
earliest.
Chouhan said certain provisions of the Act were causing extreme hardships to very Small Food Business Operators (FBO) across the country and need immediate intervention.
"Keeping in view the approaching deadline of February 4, for issue of licences and registration of FBOs, the impractical and unimplementable nature of the provisions, and the great turmoil that it has caused, the provisions of the Act need reconsideration and extensive discussion," Chouhan said in a letter to prime minister.
"The fallout of this in each state of the country also needs to be examined in detail to look for reasonable solutions. I request you, therefore, to urgently convene a meeting of all chief minsters to ascertain their views on the subject.
"Till the time the issues are fully resolved, I seek your indulgence in kindly keeping the implementation of the provisions of the Act under abeyance," Chouhan said.
He also highlighted that there are approximately seven lakh FBOs, including street hawkers and roadside vendors, in Madhya Pradesh and the provisions of the Act affect all of them in the same way.
"This (street hawkers and roadside vendors) segment, specially has been very adversely hit on account of the stringent provisions of the Act. Unable to cope with the high benchmarks prescribed, which in some cases are impractical, most will be forced to close their businesses," Chouhan added.

‘Packaged drinking water cannot be produced, sold without BIS mark’
Regulatory body makes assertion in affidavit to National Green Tribunal, Southern Bench
The Food Safety and Standards Authority of India
(FSSAI), the highest regulatory body in the country, said no person
should manufacture or sell ‘packaged drinking water’ without the Bureau
of Indian Standards (BIS) certification mark.
FSSAI
made this assertion in the form of a counter affidavit filed before the
National Green Tribunal, Southern Bench, which was hearing a suo motu
matter related to the quality of water supplied by local bodies such as
Chennai Metrowater.
Taking suo motu notice of a
letter sent by a public-spirited person, the Tribunal, in August 2013,
had issued notices to the State agencies and FSSAI. The Tribunal was
conducting a hearing on another suo motu matter related to illegal
packaged drinking water units based on a report published in The Hindu.
When
the matter came up for hearing before the Bench comprising Justice M.
Chockalingam and Prof. R. Nagendran, the counter affidavit was filed by a
counsel for FSSAI.
The counter said after the
enactment of the Food Safety and Standards (FSS) Act, 2006, the FSSAI
was the competent authority to ensure availability of safe and wholesome
food for human consumption.
The FSSAI also said the
question raised by the complainant would not fall within the ambit of
the National Green Tribunal Act, 2010.
“Mere supply
of drinking water by the State machinery/instrumentality to its people,
in view of its constitutional duty, will not per se attract the
provisions of the FSS Act and the National Green Tribunal Act, and as
such, the contention of the complainant is misplaced and misconceived,”
said FSSAI.
However, FSSAI said the specifications of packaged drinking water had already been prescribed.
“As
per Food Safety and Standards Regulations 2011, no person shall
manufacture, sell or exhibit for sale packaged drinking water under the
BIS certification mark,” it said.

Action against FBOs failing to convert licences by Feb 4: Chandramouli
Speaking
on the sidelines of a conference held at the National Institute of Food
Technology, Entrepreneurship and Management, K Chandramouli, chairman,
Food Safety and Standards Authority of India (FSSAI), said the apex food
regulator would take action against food business operators (FBO)
failing to convert their licences, as prescribed by the Food Safety and
Standards (Licensing and Registration of Food Businesses) Regulations,
2011, by February 4, 2014.
However, he said he was hopeful that the work pertaining to conversion would be completed by the prescribed date. “The deadline of February 4, 2014 is not for new licences. It is for conversions only. We expect that the conversions would be complete by the deadline. If not, we will take action. As far as new licences are concerned, it is a continual process,” he informed.
It must be mentioned here that the deadline for FBOs to obtain licences and get registered under the new set of rules is approaching, and reports suggest that the process has been sluggish in many parts of the country. While Maharashtra and Gujarat are leading, Delhi is at the bottom.
However, industry sources felt that it was highly unlikely that the conversion would be complete by the deadline. Most of them said they expected FSSAI to extend the date given the slow process of licensing and registration and the huge backlog which remained to be cleared.
When quizzed about the database for packaged drinking water, the FSSAI chairman stated that it was also a continuous process, and actually was an enforcement issue, which had to be checked constantly. Chandramouli said, “Wherever we find shortcomings, we will take action.”
When asked if there was a proposal from FSSAI regarding ban on junk food in schools, Chandramouli said that the matter had come up in the court. Only after the court’s direction would the apex regulator implement it.

Kochi: The
special ‘Operation Hot Water’ drive launched by the Ernakulam district
panchayat and the health department against eateries and other food
outlets has angered the Kerala Hotel and Restaurant Association (KHRA)
which feels they are overstepping their duties.
Noting that with the enforcement of the Food Safety Act, the role of civic authorities has been restricted to checking sanitary and hygienic conditions of eateries, KHRA state general secretary , Jose Mohan warned the association would strongly protest the closure of hotels by the civic authorities and the health department.
“They have no legal right to inspect the quality of food served take samples or seize stale food. They can only check the general hygiene of eateries. Going by the provisions of the Food Safety Act, only a qualified food analyst can collect food samples,” he said.
District panchayat president Eldhose Kunnappally , however justified the drive, saying that Operation Hot Water was essential to curb the possible outbreak of water-borne diseases. “Though the Food Safety Authority alone has the right to check the quality of food served, civic bodies can inspect the sanitation in eateries.
We planned the drive after water-borne diseases were reported from Pindimana and Pallarimangalam panchayats. Commercial ice used in the welcome drink served during a function in these areas had led to several cases of typhoid,” he added, regretting that many eateries that did not care for hygiene were affecting the health of the people who frequented them.
“ During the raid we found many hotels and bars e functioning in very poor hygiene conditions,” he said. District food safety officer, Ajith Kumar, when contacted by Deccan Chronicle, said only the Food Safety and Standards Authority of India had the right to cancel licences of eateries, and even so it acted with caution in the matter.
“Although the authority has the right to serve closure notice, such an extreme step is taken only in rare situations when a hotel is causing serious public health problems. Usually, we serve notices to eateries asking them to rectify things,” he explained.

സംസ്ഥാനത്തെ 70 ശതമാനം കച്ചവടക്കാരും രജിസ്ട്രേഷനോ ലൈസന്‍സോ എടുത്തിട്ടുണ്ടെന്നാണ് സംസ്ഥാന ഭക്ഷ്യസുരക്ഷാ വിഭാഗം പറയുന്നത്. വ്യാപാരികള്‍ക്കായി ബോധവത്കരണ ക്യാന്പുകള്‍ സംഘടിപ്പിച്ചിട്ടും ഭൂരിഭാഗവും നിയമത്തെ എതിര്‍ക്കുകയാണ്. ഭാവിയില്‍ വന്നേക്കാവുന്ന നികുതി ഭാരത്തെമുന്‍നിറുത്തിയാണ് എതിര്‍പ്പ്.
തിരഞ്ഞെടുപ്പ് അടുത്ത സാഹചര്യത്തില്‍ വ്യാപാരികളെ പിണക്കാന്‍ സര്‍ക്കാരിനാവില്ല.
