PIL alleges caffeine content beyond permitted limit in energy drink

A Public Interest Litigation (PIL) heard by the Bombay High Court on Tuesday accused the Food Safety and Standards Authority of India (FSSAI) of having made amendments to the existing regulations to permit companies, particularly Red Bull, to add caffeine in energy drinks beyond prescribed limits. The PIL states that this would have been done without evaluating the risk to health of consumers.
The amended regulations would provide caffeinated beverages to contain not less than 145 mg of caffeine per litre and not more than 320 mg per litre whereas the existing regulations state that the limit is 145 mg per litre, a bench of Justices V M Kanade and G S Kulkarni was told.
Through the amendments, the authority proposes to add caffeinated beverage as an additional category under the FSSAI, the court was informed. “By the said amendment, the authority proposes to add caffeinated beverage as an additional category. The said exercise is done only to permit the companies (that sell carbonated beverages containing caffeine and more particularly Red Bull) to add more caffeine than the standards mentioned in the existing regulations,” the PIL alleges.
According to information sought by the petitioner under the RTI, Red Bull Energy Drink in 2009 had undergone seizure of various stocks as the samples analysed by the Food and Drug Administration (FDA) revealed that the samples contained more than 200 mg per litre, which is more than the prescribed limit. The RTI further revealed that the stock of the seized drinks were ordered to be destroyed by the Alibaug judicial magistrate.
Arguing for petitioner Yajurvedi Rao, advocate Anjali Purav urged the judges to restrain the FSSAI from permitting any company to sell beverage with more caffeine than prescribed, and from creating a new category in beverages than already provided in the FSS Act 2006.
The PIL also listed out the side effects of caffeine and termed them “serious”. “Caffeine being a stimulant, it affects all parts of the body. Blood vessels in the brain constrict heart beats more intensely and the muscles contract,” it stated.
It further said, “Caffeine contributes to weight gain and obesity. Though there maybe warning on the can of the drink ‘not more than 2’, but there is no machinery or statute available to control or regulate or supervise its consumption or sale.” The FSSAI sought time to respond to the allegations levelled by the petitioner and was granted three weeks by the court to file its reply.

Review Food Safety Act: HC

While asking the government if it is willing to reconsider some of the provisions of The Food Safety and Standards Act 2011, the High Court on Friday observed that it might be difficult for hoteliers to establish laboratories to periodically test the food supplied by them.
Justice A N Venugopal Gowda said, “Even star hotels in the country have not set up laboratories to test the food that is being supplied by them. How is it practically possible for small hoteliers to establish laboratories or to get the food supplied by them tested periodically? Has the government established enough laboratories to test the food supplied in hotels? The government should think of doing things that are practical, to ensure good quality food is supplied in hotels, and improve on it later on.”
While narrating an anecdote to describe the quality of food supplied in some hotels, Justice Gowda said, “We found a cockroach in sambar when I visited a hotel along with my wife 20 years ago, and I have not visited that hotel ever since. There should some mechanism to ensure that the quality of food supplied by hotels is good.”
The solicitor general submitted before the court that it would be difficult for the common man to demand quality food despite paying for it unless the Act was implemented in its entirety.
Hoteliers comply with similar provisions when they open hotels abroad. But they oppose it when such rules are enacted in India, he added.
Justice Gowda directed the petitioners to specify the provisions that they are finding difficult to comply with, instead of opposing the Act in its entirety, during the next hearing, and adjourned the case.

Plea to Build Modern Slaughterhouses

In the wake of the recent crackdown on scores of abattoirs in the state due to lack of mandatory clearances, meat traders and labourers have demanded that local bodies build modern slaughterhouses and ensure strict enforcement of norms to save the meat industry in the state.
“Instead of building modern slaughterhouses, local bodies lease out abattoirs built without following any standards. When food safety authorities crack down on such facilities, it is the meat traders and labourers who face the brunt,’’ M Nasser, state president of Kerala Meat Merchant & Labourers’ Union, told a news conference here the other day.
Nasser said that the government should also ensure that diseased cattle do not enter through the state’s borders at a time when majority of slaughter houses in Kerala have been closed down.
“In a state like Kerala which is one of the biggest consumers of meat products, it is the responsibility of the government to ensure that good quality meat is made available to the public,’’ said S Babu, state general secretary of the Union.

Food safety licence: confusion over extension of deadline

The FSSAI’s order extends the earlier deadline for conversions/renewals of existing licences/registrations and not for new applications

The Food Safety and Standards Authority of India’s (FSSAI) order issued on Tuesday extending the deadline for food business operators to comply with Food Safety Act was said to be causing confusion among enforcement officials and business establishments.
Order
The order extended the earlier deadline of February 4 to August 4 for conversions/renewals of existing licences/registrations obtained under the earlier legislations such as Prevention of Food Adulteration Act. It does not include applications for fresh licences. The deadline for fresh licences/registrations was February 4.
A Food Safety Wing Official told The Hindu here on Wednesday that there was confusion over this order as it would not be applicable for the 12,000-odd food business operators in Coimbatore who were operating without licences or registrations.
Extension
The earlier extension order issued by FSSAI on February 5, 2013, clearly stated that the deadline had been extended by a year for those seeking conversions/renewals of existing licences, as well as for those operating without licences. With reference to the new extension, the official said that a large number of local traders and food business operators have refused to accept this difference and have appealed to the authorities not to enforce this norm.
The Food Safety Act had replaced eight legislations that covered various food products ranging from milk to meat and made it mandatory for all food businesses, from pushcarts to restaurants, to get licences/registrations. It had provisions for stringent legal action, including imprisonment, for firms violating this norm.
Officials said that they cannot begin enforcing this Central legislation without orders from the Tamil Nadu Food Safety Commissioner. As of now, orders have not yet been issued.
When the Act was notified and implemented from August 5, 2011, businesses were given an initial deadline of a year to register. It was extended from August 4, 2012, to February 4, 2013, and again to February 4 this year. This has been further extended by another six months.
A senior official said: “What the food traders do not realise is that they were all covered under this Act regardless of whether they have got registrations/licences. Their products would have to conform to FSSAI standards, failing which they would face legal consequences.”

Chouhan urges PM to convene meeting of CMs on Food Safety Act

Madhya Pradesh Chief Minister Shivraj Singh Chouhan has written to Prime Minister Manmohan Singh demanding that implementation of the Food Safety and Standards Act 2006 be kept in abeyance until issues concerning its provisions are resolved and also urged him to convene a meeting of all chief ministers at the earliest.
Chouhan said certain provisions of the Act were causing extreme hardships to very Small Food Business Operators (FBO) across the country and need immediate intervention.
"Keeping in view the approaching deadline of February 4, for issue of licences and registration of FBOs, the impractical and unimplementable nature of the provisions, and the great turmoil that it has caused, the provisions of the Act need reconsideration and extensive discussion," Chouhan said in a letter to prime minister.
"The fallout of this in each state of the country also needs to be examined in detail to look for reasonable solutions. I request you, therefore, to urgently convene a meeting of all chief minsters to ascertain their views on the subject.
"Till the time the issues are fully resolved, I seek your indulgence in kindly keeping the implementation of the provisions of the Act under abeyance," Chouhan said.
He also highlighted that there are approximately seven lakh FBOs, including street hawkers and roadside vendors, in Madhya Pradesh and the provisions of the Act affect all of them in the same way.
"This (street hawkers and roadside vendors) segment, specially has been very adversely hit on account of the stringent provisions of the Act. Unable to cope with the high benchmarks prescribed, which in some cases are impractical, most will be forced to close their businesses," Chouhan added.

‘Packaged drinking water cannot be produced, sold without BIS mark’

Regulatory body makes assertion in affidavit to National Green Tribunal, Southern Bench

The Food Safety and Standards Authority of India (FSSAI), the highest regulatory body in the country, said no person should manufacture or sell ‘packaged drinking water’ without the Bureau of Indian Standards (BIS) certification mark.
FSSAI made this assertion in the form of a counter affidavit filed before the National Green Tribunal, Southern Bench, which was hearing a suo motu matter related to the quality of water supplied by local bodies such as Chennai Metrowater.
Taking suo motu notice of a letter sent by a public-spirited person, the Tribunal, in August 2013, had issued notices to the State agencies and FSSAI. The Tribunal was conducting a hearing on another suo motu matter related to illegal packaged drinking water units based on a report published in The Hindu.
When the matter came up for hearing before the Bench comprising Justice M. Chockalingam and Prof. R. Nagendran, the counter affidavit was filed by a counsel for FSSAI.
The counter said after the enactment of the Food Safety and Standards (FSS) Act, 2006, the FSSAI was the competent authority to ensure availability of safe and wholesome food for human consumption.
The FSSAI also said the question raised by the complainant would not fall within the ambit of the National Green Tribunal Act, 2010.
“Mere supply of drinking water by the State machinery/instrumentality to its people, in view of its constitutional duty, will not per se attract the provisions of the FSS Act and the National Green Tribunal Act, and as such, the contention of the complainant is misplaced and misconceived,” said FSSAI.
However, FSSAI said the specifications of packaged drinking water had already been prescribed.
“As per Food Safety and Standards Regulations 2011, no person shall manufacture, sell or exhibit for sale packaged drinking water under the BIS certification mark,” it said.

Action against FBOs failing to convert licences by Feb 4: Chandramouli

Speaking on the sidelines of a conference held at the National Institute of Food Technology, Entrepreneurship and Management, K Chandramouli, chairman, Food Safety and Standards Authority of India (FSSAI), said the apex food regulator would take action against food business operators (FBO) failing to convert their licences, as prescribed by the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, by February 4, 2014.

However, he said he was hopeful that the work pertaining to conversion would be completed by the prescribed date. “The deadline of February 4, 2014 is not for new licences. It is for conversions only. We expect that the conversions would be complete by the deadline. If not, we will take action. As far as new licences are concerned, it is a continual process,” he informed.

It must be mentioned here that the deadline for FBOs to obtain licences and get registered under the new set of rules is approaching, and reports suggest that the process has been sluggish in many parts of the country. While Maharashtra and Gujarat are leading, Delhi is at the bottom.

However, industry sources felt that it was highly unlikely that the conversion would be complete by the deadline. Most of them said they expected FSSAI to extend the date given the slow process of licensing and registration and the huge backlog which remained to be cleared.

When quizzed about the database for packaged drinking water, the FSSAI chairman stated that it was also a continuous process, and actually was an enforcement issue, which had to be checked constantly. Chandramouli said, “Wherever we find shortcomings, we will take action.”

When asked if there was a proposal from FSSAI regarding ban on junk food in schools, Chandramouli said that the matter had come up in the court. Only after the court’s direction would the apex regulator implement it.

'Operation Hot Water’ drive by the Ernakulam district panchayat and health department

http://www.deccanchronicle.com
Kochi: The special ‘Operation Hot Water’ drive launched by the Ernakulam district panchayat  and  the health department against eateries and other food outlets has angered the Kerala Hotel and Restaurant Association (KHRA)  which feels they are overstepping their duties.
Noting that with the enforcement of  the Food Safety Act, the role of civic authorities has been restricted to checking sanitary and hygienic conditions of eateries, KHRA state general secretary , Jose Mohan warned  the association would strongly protest the closure  of hotels by the civic authorities and the health department.
“They have no legal right to inspect the quality of food served   take samples or seize stale food. They can only check the general hygiene of eateries. Going by the provisions of the Food Safety Act, only a qualified food analyst can collect food samples,” he said.
District panchayat president  Eldhose Kunnappally , however justified the drive, saying that Operation Hot Water was essential to curb the possible outbreak of water-borne diseases. “Though the Food Safety Authority alone has the right to check the quality of food served, civic bodies can inspect the sanitation in eateries.
We planned the drive after  water-borne diseases were reported from Pindimana and Pallarimangalam panchayats.  Commercial ice used in the welcome drink served during a function in these areas had led to several cases of typhoid,”  he added, regretting that  many eateries that did not care for hygiene were affecting the health of the people who frequented them.
“ During the raid we found  many hotels and bars e functioning in very poor hygiene conditions,”  he said. District food safety officer,   Ajith Kumar, when contacted by Deccan Chronicle,  said  only the  Food Safety and Standards Authority of India had the right to cancel licences of eateries, and even so it acted with caution in the matter.
“Although the authority has the right to serve closure notice, such an extreme step is taken only in rare situations when a hotel is causing serious public health problems. Usually, we serve notices to eateries asking them to rectify things,” he explained.

Mid-day Meal: Authorities Insensitive to DPI Circular

To prevent another mid-day meal tragedy on the lines of the one in Bihar which claimed the lives of 23 schoolchildren in July, Director of Public Instruction (DPI) Biju Prabhakar, who is also in-charge of the Food Safety Department, issued a circular, with 21 crucial directives, on October 30 to all schools in the state to ensure safety in mid-day meal supply. However, the school authorities are turning a blind eye to the directives.
The circular, issued two months ago, had no impact on the schools so far. The circular instructs each school to register their kitchen under the Food Safety Department (FSD) with proper details of the storage facility, kitchen facility, health of kitchen employees, hygienic measures taken etc. But so far, the FSD has not received even a single application from any school for registration.  February 4, 2014 is the last date for submitting applications. The circular also instructs the authorities of schools to ensure the fitness of kitchen employees by conducting periodical medical checkups. This directive was also not taken into serious consideration by schools. “There are high chances for diseases to spread from cooks to kids through food. So the health of cooks must be ensured. Diseases such as typhoid can be transmitted through unclean food habits,” M K Appunni, retired DMO, said.
The Food Safety Department conducted inspections in the schools across the state a few months ago and it revealed that kitchens in most of the schools were functioning under unhygienic conditions. “None of the schools have proper storage facilities and due to this the grains are getting spoiled. Kitchens in all the schools are functioning under unhygienic conditions. It is the key reason why the directives were issued,” Food Safety Officer Mini A K said.
School headmasters complain that they have not received any proper directives in this regard. “I saw the circular on the Education Department’s website but I did not get any directive from the Deputy Director of Education yet. Anyway let me look into it,” Head Master of Kalanjoor LP School, Konni, Sree Kumar K said.
“We issued such a circular to create awareness among the school authorities. We will assist them in implementing the directives. We sought Central Government fund for its implementation,” Biju Prabhakar said. He also said this was not the phase for taking action against anyone. “Our sole intention is to make the school authorities aware of healthy ways to prevent diseases. Once this phase gets over, we won’t compromise and strict action will be taken against all those who violate the norms in the circular,” Biju Prabhakar said.
 Some of the Major Directives
■ A senior teacher will ensure whether food is supplied strictly under the Food Safety Regulations Act or not. The teacher must also be a member of the Food committee. In addition to the senior teacher, a doctor from the Primary Health Centre and a representative of students must also be there in the Food committee.
■ Food materials should be bought only from a shop registered under the Food Safety Act.
■ Food materials must be stored in safe storage rooms.
■ The contact number of the Food Safety Officer should be displayed on the notice board of schools.
■ Mandatory chemical and microbiological tests must be done periodically to ensure the quality of drinking and cooking water.
■ Kitchen staff must be free of diseases and periodical health checkups must be done.
■ Cooking should not be done in open air.
■ Keep urinal, latrines etc away from the kitchen and must be cleaned.
■ Drainage must be covered.
■  Kitchen workers should have separate living rooms.
